THE REALPRIZE SERVICES, WHICH INCLUDE WITHOUT LIMITATION THE SWEEP COINS MODE CONTESTS ARE NOT “REAL MONEY GAMBLING”. NO ACTUAL MONEY IS REQUIRED TO PLAY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCE OF WINNING.
THE REALPRIZE SERVICES WHICH INCLUDE WITHOUT LIMITATION THE SWEEP COINS MODE CONTESTS ARE INTENDED FOR RECREATIONAL AND ENTERTAINMENT PURPOSES ONLY AND ARE VOID WHERE PROHIBITED.
THE MINIMUM AMOUNT OF CASH WHICH CAN BE OBTAINED BY REDEEMING REDEEMABLE SWEEP COINS IS 100 UNITED STATES DOLLARS AND FORTY-FIVE (45) UNITED STATES DOLLARS FOR GIFT CARD PRIZES, WHICH MAY BE AMENDED AT ANY TIME BY US. REDEMPTIONS BELOW THE RELEVANT THRESHOLD ARE NOT ELIGIBLE FOR REDEMPTION.
THE SWEEP COINS MODE CONTESTS ARE SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS AND ARE VOID WHERE PROHIBITED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED BUT HAVE NOT BEEN MET, OR WHERE THE METHODS OF ENTRY SET FORTH BELOW WOULD BE DEEMED CONSIDERATION.
THESE PROMOTIONAL PLAY RULES INCORPORATE CLAUSE 25 (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE ON AN INDIVIDUAL BASIS) IN THE GENERAL TERMS AND CONDITIONS, WHICH INCLUDE A PROVISION WAIVING THE RIGHT TO PURSUE ANY CLASS, GROUP OR REPRESENTATIVE CLAIM AND REQUIRING YOU TO PURSUE PAST, PENDING, AND FUTURE DISPUTES BETWEEN YOU AND US THROUGH INDIVIDUAL ARBITRATION UNLESS YOU OPT OUT WITHIN THE SPECIFIED TIME FRAME.
YOU MAY ONLY ACCESS THE SITE AND USE THE REALPRIZE SERVICES WHICH INCLUDES WITHOUT LIMITATION SWEEP COINS MODE CONTESTS, IF YOU ARE LOCATED IN AND A RESIDENT OF THE UNITED STATES (EXCEPT IF YOU ARE LOCATED IN OR A RESIDENT OF THE STATE OF WASHINGTON, THE STATE OF IDAHO, THE STATE OF CONNECTICUT, THE STATE OF NEVADA, THE STATE OF NEW YORK, THE STATE OF MICHIGAN OR THE STATE OF MONTANA).
FOR INFORMATION AND RULES REGARDING THE ALTERNATIVE METHOD OF ENTRY TO RECEIVE SWEEP COINS, PLEASE SEE CLAUSE 7 (GRANTING OF SWEEP COINS) BELOW.
The Sweep Coins Mode Contests provided through the Site are offered and operated by REALPLAY TECH INC, using software developed by Realplay Ltd.
1.1 REALPLAY TECH INC, a corporation duly organized under the laws of the State of Delaware, United States and its Related Entities including Realplay Ltd (“Sponsor”, “Promoter”, “Company”, “we”, “us” or “our”), is the sole sponsor of the Sweep Coins Mode Contests.
1.2 APPLE AND GOOGLE ARE NOT SPONSORS OF, RESPONSIBLE FOR CONDUCTING THE SWEEP COINS MODE CONTESTS, OR INVOLVED WITH THE SWEEP COINS MODE CONTESTS IN ANY MANNER.
2.1 Terms which are defined in the General Terms and Conditions and which are used in these Promotional Play Rules shall have the meaning given to them in the General Terms and Conditions, unless otherwise defined in these Promotional Play Rules.
2.2 You hereby agree to comply and be bound at all times by these Promotional Play Rules and the rest of the RealPrize Agreement.
2.3 Sweep Coins Mode Contests are governed by applicable federal, state, provincial, territorial and local laws and regulations. You are solely responsible for determining whether the Sweep Coins Mode Contests are legal and comply with all laws and regulations in the jurisdiction where you are located.
2.4 ANY ATTEMPT TO DELIBERATELY DAMAGE THE SWEEP COINS MODE CONTESTS OR THE SITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEP COINS MODE CONTESTS IS A VIOLATION OF CRIMINAL AND CIVIL LAWS.
2.5 PARTICIPATING IN THE SWEEP COINS MODE CONTESTS IS YOUR FULL AND UNCONDITIONAL AGREEMENT TO THESE PROMOTIONAL PLAY RULES, THE GENERAL TERMS AND CONDITIONS AND OUR DECISIONS, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEP COINS MODE CONTESTS.
3.1 WE MAY AT ANY TIME ADD, MODIFY, REMOVE, DISCONTINUE OR SUSPEND THE SWEEP COINS MODE CONTESTS OR ANY PART THEREOF WITH IMMEDIATE EFFECT AND WITHOUT NOTICE TO YOU.
3.2 In no event will the Company be liable to you for any loss, damage or liability suffered by you which results from any addition, modification, removal or suspension of the Sweep Coins Mode Contests or any part thereof.
4.1 Any personal information which you provide us is governed by our Privacy Policy.
5.1 In order to participate in the Sweep Coins Mode Contests, you must comply with the eligibility requirements of Clause 7 (ELIGIBLE USER QUALIFICATIONS) of the General Terms and Conditions.
5.2 You hereby represent and warrant to us that at all times:
5.2.1 You comply with the eligibility requirements.
5.2.2 You are fully capable of entering into and complying with the Promotional Play Rules.
5.2.3 You are located in the U.S. but not in WA, ID, CT, NV, NY, MI, or MT.
5.2.4 You shall fully comply with these Promotional Play Rules and the General Terms and Conditions.
6.1 To participate in the Sweep Coins Mode Contests, you must have an active User Account.
6.2 The User Account must not be an Inactive User Account.
6.3 You can create a User Account through the Site, at no cost, as registration is free and does not require you to make any purchase.
6.4 When participating in Sweep Coins Mode Contests, you may use Sweep Coins for the chance to win Redeemable Sweep Coins, which can be redeemed for Sweep Prizes in accordance with the General Terms and Conditions and these Promotional Play Rules.
7.1 After successfully registering a User Account (which is free to create and at no cost) and provided that your User Account is not an Inactive User Account, you may, at our discretion, receive Sweep Coins for free in the following ways:
7.1.1 As a Bonus for Registering a User Account and Logging in Within Three Days of the User Account Registration:
You may receive Sweep Coins if you register a User Account and log in to such User Account within three days of registering the User Account.
7.1.2 As a Daily Bonus:
You may obtain Sweep Coins daily by logging into your account each day and claiming the Daily Bonus. You may only claim the Daily Bonus once per each 24-hour period. The amount of Sweep Coins you shall obtain shall be made available to you through the Site, Site Content or via a pop up.
7.1.3 Social Network Giveaways or Challenges:
We may hold Sweep Coins no-cost giveaway contests or challenges on the RealPrize social media pages, which you can enter by following the instructions provided in the contest or challenge. These giveaways may require the sharing, liking, commenting or other interaction with a specific social media post, completing a challenge or answering various game related questions to be eligible for entry. The amount of Sweep Coins given away in such contests and challenges will be stated on the relevant Sweep Coins no-cost contest post and will be added to each contest or challenge winner’s User Account after the conclusion of the contest or challenge (as applicable).
These contests and challenges may be subject to additional restrictions and rules as referenced in the contest materials at the time of the contest as well as the General Terms and Conditions and the Promotional Play Rules in effect at the time.
7.1.4 As A Bonus for Purchasing Gold Coins:
When purchasing specifically designated Gold Coin packages, you may receive Sweep Coins as a free bonus.
7.1.5 Through the Loyalty Club:
You may receive Gold Coins for participating in the Loyalty Club.
7.1.6 Through Various Promotional Campaigns (for example Referring A Friend Bonus):
You may receive Sweep Coins as a bonus through participating in various promotions that we may run from time to time, subject to your compliance with the RealPrize Agreement and the relevant Promotion Terms.
7.1.7 Requesting Sweep Coins by Post (“RealPrize Written Request”): In order to provide us with a RealPrize Written Request you must:
7.1.7.1 Use an unfolded, blank, unlined, 4″ x 6″ postcard or piece of white paper (“AMOE RealPrize Entry”), which must contain the following information which is handwritten in BLUE INK (typed or printed text will not be accepted) on one side of the AMOE RealPrize Entry which is legible to us and inserted in the AMOE RealPrize Envelope:
(a) Your full name as shown on your government issued identification and matching your username.
(b) Your email address registered with your User Account.
(c) The return/residential address registered with your User Account.
(d) The time and date of writing.
(e) The following statement:
“I wish to receive Sweep Coins to participate in the Sweep Coins Mode Contests offered by REALPLAY. By submitting this request, I declare that I have read, understood, and hereby agree to be bound by REALPLAY’S General Terms and Conditions and Promotional Play Rules.”
7.1.7.2 You must insert the AMOE RealPrize Entry inside a stamped #10 envelope (“AMOE RealPrize Envelope”). In addition, the AMOE RealPrize Envelope must contain the following information in BLUE INK (typed or printed text will not be accepted) on the front of the AMOE RealPrize Envelope, which is legible to us:
(i) Sweepstake Credits
(ii) Your return address
(iii) realprize.com
The AMOE RealPrize Envelope must be sent to: RealPrize, PO BOX 9303, Manchester, NH 03108
7.2 The granting of the Sweep Coins through a RealPrize Written Request is also subject to:
7.2.1 the RealPrize Written Request must be made by you and mailed from the same State as your verified residential address registered to your User Account;
7.2.2 you must not electronically copy or duplicate any RealPrize Written Request or any part thereof;
7.2.3 your handwriting on the AMOE RealPrize Envelope and the AMOE RealPrize Entry being legible (as determined by us) if it is not legible, the RealPrize Written Request will be void;
7.2.4 a limit of one AMOE RealPrize Entry per AMOE RealPrize Envelope;
7.2.5 any RealPrize Written Request made by any other individual or any entity other than you (including but not limited to commercial sweepstakes subscription notification or entering services) shall be invalid;
7.2.6 in the event a dispute regarding the identity of the individual who actually submitted a RealPrize Written Request or whether a RealPrize Written Request satisfies the requirements detailed in Clause 7.1.7 and this Clause 7.2, is not resolved to our satisfaction, we may determine that such RealPrize Written Request will be deemed invalid;
7.2.7 tampering with the process with respect to the RealPrize Written Request, including but not limited to the use of any device or software to automate the RealPrize Written Request or to unfairly assist you with meeting the handwriting requirement, is prohibited and any such RealPrize Written Request deemed by us, in our sole discretion to have been submitted in this manner will be void;
7.2.8 if in our sole discretion, there is an issue or fault with the AMOE RealPrize Envelope, such that it does, or is reasonably likely to, cause damage to, or otherwise adversely affect, equipment used or procedures implemented to process mailed in requests (for example, handmade envelopes that are not suitable for machine processing due to poor quality or non-standard adhesive or paper) such RealPrize Written Request will be void; or
7.2.9 in the event of a dispute as to any registration of a User Account, the authorized account holder of the email address used to register the User Account will be deemed to be the person seeking to obtain the Sweep Coins.
7.3 In addition:
7.3.1 the RealPrize Written Request which includes without limitation the AMOE RealPrize Entry and AMOE RealPrize Envelope shall belong to us;
7.3.2 any RealPrize Written Request which we deem in our sole discretion to be invalid will not be acknowledged or returned to you; and
7.3.3 we are not responsible for any lost, incomplete, illegible, misaddressed or otherwise invalid RealPrize Written Request.
7.4 For every RealPrize Written Request which complies with Clauses 7.1.7 and 7.2, you shall receive one Sweep Coin. The Sweep Coin shall be added to your User Account upon our verification of the RealPrize Written Request complying with Clause 7.1 and 7.2. Please note that it may take up to 20 days from our receipt of a verified RealPrize Written Request to credit your User Account with the Sweep Coin.
7.5 You agree that we have the right to vary the number of Sweep Coins allocated for each RealPrize Written Request at any time and from time to time, by amending the number in these Promotional Play Rules.
8.1 Sweep Coins can be used to play Sweep Coins Mode Contests for a chance to obtain Redeemable Sweep Coins.
8.2 Sweep Coins cannot be purchased and have no monetary value. Sweep Coins cannot be withdrawn or transferred or exchanged, however, Redeemable Sweep Coins may be redeemed for Sweep Prizes.
8.3 The amount of Sweep Coins which are credited to you will be displayed in the Sweep Coins wallet in your User Account.
8.4 Sweep Coins can only be used in the Sweep Coins Mode Contests, and you may only participate in Sweep Coins Mode Contests, if you possess a sufficient number of Sweep Coins for playing the relevant Contest in the Sweep Coins wallet in your User Account.
8.5 The number of Sweep Coins required for playing each Contest in the Sweep Coins Mode Contests is displayed in either the applicable Contest rules or in the Contest itself.
8.6 Once you select Sweep Coins for use in Sweep Coins Mode Contests and our acceptance of this, you cannot cancel the use of such Sweep Coins and such Sweep Coins will be deducted from the Sweep Coins wallet in your User Account.
8.7 We reserve the right to remove, expire, limit, change, manage, regulate, control, modify or eliminate Sweep Coins, whether generally or specifically to you and we shall have no liability to you with respect to the exercise of such rights.
8.8 You agree not to transfer, attempt to transfer, assign, attempt to assign, sub-license, attempt to sublicense, sell, attempt to sell, give, attempt to give, trade or attempt to trade, Sweep Coins. Any such attempt by you is prohibited and void.
8.9 We may at our discretion notify you that your Sweep Coins may expire or have expired, but we shall have no obligation to do so.
8.10 In the event of an incorrect crediting of Sweep Coins to you, you agree that as soon as you become aware of this you shall immediately notify us by email at: [email protected].
Sweep Prizes Restrictions
9.1 The minimum amount which can be obtained by redeeming Redeemable Sweep Coins, which may be amended at our discretion at any time and without notice to you, is:
9.1.1 Forty-five (45) United States Dollars for Gift Card Prizes; and
9.1.2 One hundred (100) United States Dollars for Sweep Prizes which are cash.
9.2 Sweep Coins granted to you cannot be directly redeemed for Sweep Prizes: (i) Sweep Coins granted to you must be played at least once on the Sweep Coins Mode Contests before Sweep Prizes can be obtained by redeeming Redeemable Sweep Coins; or (ii) however, at our discretion, we may require that any Sweep Coins granted to you must be played a greater number of times in any combination of Sweep Coins Mode Contests before Sweep Prizes can be obtained by redeeming Redeemable Sweep Coins ((i) and (ii) collectively the “Play Through Requirements”).
9.3 We may impose limits on the amount of Redeemable Sweep Coins you can redeem, per day or to any other amount as determined by us or required by applicable law, regulation or our service providers, as notified to you through the RealPrize Agreement or the Site Content.
Without detracting from the paragraph above, at present:
9.3.1 the maximum amount of Redeemable Sweep Coins which you may redeem for Sweep Prizes, is capped at 10,000 USD per day; and
9.3.2 you can only have one redemption request to redeem Redeemable Sweep Coins for Sweep Prizes open at any one time, you will only be able to make a redemption request to redeem Redeemable Sweep Coins for Sweep Prizes, if no other redemption request is pending approval by us.
9.4 We reserve the right to remove, expire, limit, change, manage, regulate, control, modify or eliminate Redeemable Sweep Coins, whether generally or specifically to you and we shall have no liability to you with respect to the exercise of such rights.
9.5 If you are located in or registered in the State of Florida, a cap of 5,000 United States Dollars will apply to any Redeemable Sweep Coins won on any one spin, play or equivalent.
9.6 Sweep Prizes can only be obtained by redeeming Redeemable Sweep Coins subject to Clauses 9.1-9.5 (inclusive).
Obtaining Sweep Prizes
9.7 The amount of Redeemable Sweep Coins which are credited to you will be displayed in the Sweep Coins wallet in your User Account.
9.8 Upon redeeming the Redeemable Sweep Coins to obtain a Sweep Prize and our acceptance of this, you cannot cancel the redemption of such Redeemable Sweep Coins.
9.9 We may charge you processing fees for the redemption of Redeemable Sweep Coins for Sweep Prizes as notified to you through the Site Content.
Additional Redemption Provisions
9.10 Sweep Prizes shall not be substituted, assigned or transferred by you. We reserve the right to substitute a Sweep Prize with one of a greater or equal value.
9.11 You are solely responsible for ensuring that the email address and brick and mortar address (as applicable) which is associated with your User Account is correct and up to date. We are not liable if Sweep Prizes are not delivered due to incorrect information.
9.12 Prior to your redemption of any Sweep Prizes, you may be required by us to submit via the Site your government issued identification.
9.13 In addition to Clause 9.12, you may also be required to send to us via email or via the US postal system:
9.13.1 an affidavit/declaration of eligibility as provided by us,
9.13.2 a publicity/liability agreement/release as provided by us; and
9.13.3 appropriate tax forms.
All such documentation and forms must be provided by you within thirty (30) days of our request. Your failure to comply with these requirements (which includes without limitation failing to properly execute and return the affidavit/declaration of eligibility and the publicity/liability agreement/release by the deadline or your failure to properly complete the tax forms by the deadline), may at our discretion result in your disqualification and your forfeiture of the Sweep Prize and the Redeemable Sweep Coins used to redeem such Sweep Prize.
9.14 For the avoidance of doubt, prior to your redemption of any Sweep Prizes, we reserve the right to conduct verification checks as detailed in Clause 6 (VERIFICATION CHECKS) in the General Terms and Conditions and Clause 14 (VERIFICATION OF REDEEMABLE SWEEP COINS) below.
9.15 We shall have no liability to you with respect to your use of any Sweep Prizes.
9.16 In the event that you redeem a Gift Card Prize in physical format, once it leaves our or our supplier’s premises (as applicable), we shall have no further liability to you with respect of such Gift Card Prize.
9.17 There may be third party terms and conditions which apply to the Gift Card Prizes which you have redeemed, which includes without limitation an expiration date. It is solely your responsibility to be aware of and comply with such third-party terms and conditions and we shall have no liability to you if you fail to comply with such terms and conditions.
9.18 In the event of an incorrect crediting of a Sweep Prize to you, you agree that as soon as you become aware of this you shall immediately notify us by email at: [email protected].
9.19 Please be aware that Sweep Prize redemptions with a value equal to or greater than 2,500 USD may require a longer processing time due to banking, security and fraud checks and controls and may also be provided in several installments rather than in one lump sum. Without detracting from the foregoing, we reserve the right to allocate or pay Sweep Prizes in smaller installments over a number of days until all of the Sweep Prize has been paid.
9.20 If you redeem any Redeemable Sweep Coins for a physical Gift Card Prize, subject to the RealPrize Agreement, we will send the physical Gift Card Prize to the brick and mortar address associated with your User Account when you select such physical Gift Card Prize. If the physical Gift Card Prize is not delivered to you, we shall have no liability to you and for the avoidance of doubt we shall not be liable to provide you with a replacement physical Gift Card Prize.
9.21 If you redeem any Redeemable Sweep Coins for a digital Gift Card Prize, subject to RealPrize Agreement, we will send the digital Gift Card Prize to the email address associated with your User Account when you select such digital Gift Card Prize. If the digital Gift Card Prize is not delivered to you, we shall have no liability to you and for the avoidance of doubt we shall not be liable to provide you with a replacement digital Gift Card Prize.
Cash Redemptions
9.22 If you redeem any Redeemable Sweep Coins for cash, subject to the RealPrize Agreement, we will pay such amount in USD to the Remittance Instrument. If for any reason we cannot pay cash to the Remittance Instrument we may choose to pay you via the Additional Remittance Instrument, which we at our discretion may select.
9.23 In addition, if you redeem any Redeemable Sweep Coins for cash, it is solely your responsibility to ensure that the details of the Remittance Instrument and the Additional Remittance Instrument are correct and up to date. If the redeemed cash does not reach you, as the details are not correct and up to date, we shall not be liable to reverse or re-issue the cash.
9.24 Payment processing is handled by one of our Related Entities, Realplay (EU) Limited with an address at Madison Building Midtown, Queensway, Gibraltar – GX11 1AA.
10.1 Prior to your redemption in aggregate of 600 United States Dollars or more in Redeemable Sweep Coins over one calendar year, we may suspend your ability to redeem Redeemable Sweep Coins, until you provide us with your address and social security details as well as any other information and documentation we may request. These details may be used to allow us to comply with tax regulations and may be shared with appropriate tax authorities.
If we do not receive such information and documentation, or at our sole discretion we believe that such information or documentation is incomplete, false or inaccurate, such suspension shall remain, until we have received such documentation and information to our satisfaction.
For the avoidance of doubt, this Clause shall in no way detract from our rights in Clause 6 (VERIFICATION CHECKS) in the General Terms and Conditions and Clause 14 (VERIFICATION OF REDEEMABLE SWEEP COINS) below nor from terminating or suspending your User Account.
10.2 We may decide in our sole discretion whether we wish to provide any details to you in connection with your individual tax filing obligations, or otherwise. We do not offer any tax advice. If you require any tax advice or assistance regarding tax matters, you should consult with an appropriate advisor, please see Clause 8.2 (WE DO NOT PROVIDE LEGAL AND TAX ADVICE AND WE ARE NOT A FINANCIAL INSTITUTION) in the General Terms and Conditions.
10.3 Your redemption of any Redeemable Sweep Coins for Sweep Prizes and Sweep Prizes are exclusive of all Relevant Taxes, which you solely shall be responsible to pay.
10.4 In addition, we reserve the right to charge you any Relevant Taxes or charge a fee to offset any Relevant Taxes.
10.5 All payments made by us and the redemption of any Redeemable Sweep Coins for Sweep Prizes, shall be inclusive of all Relevant Taxes which you solely shall be responsible to pay.
10.6 In the event that under applicable law, we are required to deduct and withhold any amount from Sweep Prizes and to pay over to the relevant tax authorities, any amount on account of Relevant Taxes, any such amount deducted and withheld by the Company shall be deemed paid to you for all purposes hereunder.
10.7 You are solely responsible for filing and paying applicable state, local and federal taxes, duties, levies or fees on Redeemable Sweep Coins and Sweep Prizes.
FOR THE AVOIDANCE OF DOUBT, CLAUSE 25 (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE ON AN INDIVIDUAL BASIS) OF THE GENERAL TERMS AND CONDITIONS IS INCORPORATED HEREIN BY REFERENCE WITH THE SAME FORCE AND EFFECT AS THOUGH FULLY SET FORTH HEREIN. BY AGREEING TO THESE PROMOTIONAL PLAY RULES, YOU AGREE TO BE BOUND BY THE DISPUTE RESOLUTION AND ARBITRATION PROVISIONS CONTAINED IN CLAUSE 25 (DISPUTE RESOLUTION AND AGREEMENT TO ARBITRATE ON AN INDIVIDUAL BASIS) OF THE GENERAL TERMS AND CONDITIONS.
12.1 By playing on the Sweep Coins Mode Contests, you agree to release and hold harmless each entity in the Company and each of their respective officers, directors, employees, shareholders, stockholders, agents, partners, licensors, subcontractors, suppliers and any entity responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweep Coins Mode Contests (collectively the “Discharged Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to:
12.1.1 invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory);
12.1.2 defamation, slander, libel, violation of publicity;
12.1.3 infringement of trademark, copyright or other intellectual property rights; and
12.1.4 property damage, or death or personal injury, arising or relating to the AMOE RealPrize Entry.
13.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW AND SUBJECT TO THE LIMITATIONS SET OUT IN CLAUSE 29.2 (LIMITATIONS OF LIABILITY) IN THE GENERAL TERMS AND CONDITIONS, UNDER NO CIRCUMSTANCES WHATSOEVER WITH RESPECT TO YOUR PARTICIPATION IN THE SWEEP COINS MODE CONTESTS, WILL YOU BE ALLOWED TO OBTAIN ANY AWARD FOR AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES, OR ANY OTHER DAMAGES, (INCLUDING BUT NOT LIMITED TO ATTORNEYS’ FEES), OTHER THAN YOUR ACTUAL OUT-OF-POCKET EXPENSES (THAT IS COSTS ASSOCIATED WITH YOUR PARTICIPATION IN THE SWEEP COINS MODE CONTESTS) AND YOU FURTHER WAIVE ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
13.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES WHATSOEVER WILL THE DISCHARGED PARTIES, BE RESPONSIBLE FOR:
13.2.1 ANY INCORRECT OR INACCURATE INFORMATION PROVIDED, WHETHER CAUSED BY YOU OR CAUSED BY A PRINTING ERROR OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE SWEEP COINS MODE CONTESTS;
13.2.2 ANY INCORRECT OR INACCURATE INFORMATION PROVIDED WITH RESPECT TO ANY REALPRIZE WRITTEN REQUEST INCLUDING BUT NOT LIMITED TO IF CAUSED BY YOU OR FOR ANY FAULTY OR FAILED ELECTRONIC DATA TRANSMISSIONS OR PRINTING ERROR;
13.2.3 ANY TECHNICAL OR HUMAN ERROR IN RESPECT OF THE OPERATION OR ADMINISTRATION OF SWEEP COINS MODE CONTESTS AND ANY UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE AMOE REALPRIZE ENTRY PROCESS OR THE SWEEP COINS MODE CONTESTS;
13.2.4 ANY UNAUTHORIZED ACCESS TO, OR THEFT, DESTRUCTION, OR ALTERATION, OF REQUESTS FOR SWEEP COINS;
13.2.5 ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY (IN WHOLE OR IN PART) BE RELATED TO OR RESULTING FROM YOUR PARTICIPATION IN THE SWEEP COINS MODE CONTESTS OR THE DOWNLOAD OF ANY MATERIALS RELATED TO SWEEP COINS MODE CONTESTS;
13.2.6 ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY (IN WHOLE OR IN PART) BE RELATED TO OR RESULTING FROM THE RECEIPT, USE OR MISUSE OF ANY SWEEP PRIZE; OR
13.2.7 ANY TECHNICAL MALFUNCTION, INTERRUPTION FAILURE OR ERROR, INCLUDING WITHOUT LIMITATION ANY DISCONNECTION DELAY, INTERRUPTION OR DEFECT IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE.
13.3 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, SITE CONTENT, OR SWEEP PRIZES OR THE PROMOTIONAL PLAY RULES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE.
14.1 POTENTIAL WINNERS OF REDEEMABLE SWEEP COINS ON SWEEP COINS MODE CONTESTS ARE SUBJECT TO VERIFICATION BY US IN ANY MANNER WE MAY CHOOSE WHICH INCLUDES WITHOUT LIMITATION THE VERIFICATION CHECKS STATED IN CLAUSE 6 (VERIFICATION CHECKS) IN THE GENERAL TERMS AND CONDITIONS.
14.2 YOU ARE NOT A WINNER OF ANY OF REDEEMABLE SWEEP COINS ON SWEEP COINS MODE CONTESTS, EVEN IF THE REALPRIZE SERVICES INDICATE YOU ARE, UNLESS AND UNTIL YOUR ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED BY US TO OUR SATISFACTION AND WE HAVE ESTABLISHED THAT YOU HAVE FULLY COMPLIED WITH THESE PROMOTIONAL PLAY RULES AND THE REST OF THE REALPRIZE AGREEMENT AND YOU HAVE BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.
14.3 WE WILL NOT ACCEPT ANY PURPORTED EVIDENCE OF WINNING IN LIEU OF OUR VALIDATION PROCESS.
14.4 If you are granted Redeemable Sweep Coins on Sweep Coins Mode Contests, you may be required by us to return via the Site your government issued identification. You may also be required to send via email or via the US postal system:
14.4.1 an affidavit/declaration of eligibility as provided by us;
14.4.2 a publicity/liability agreement/release as provided by us; and
14.4.3 appropriate tax forms,
by a deadline specified by us. Failure to comply with these requirements (which includes without limitation failing to properly execute and return the affidavit/declaration of eligibility and the publicity/liability agreement/release by the deadline or your failure to properly complete the tax forms by the deadline), at our discretion may result in disqualification and your forfeiture of the Redeemable Sweep Coins.
14.5 If you are a tentative winner and cannot be contacted by us or you cannot be verified by us in a timely manner, you may at our discretion be disqualified, in which case you will forfeit and have no right to the Sweep Prize.
15.1 You may submit a request for a list of winners with respect to any one spin, play, or equivalent or equivalent on Sweep Coins Mode Contests, within a year of that date, by sending a self-addressed, stamped envelope stating “I am formally requesting the list of Sweep winners from the following Sweep Coins Mode Contests” along with reference to the relevant Contest played in Sweep Coins Mode Contests, the month, day, and year of the date, entry fee, and prize offered as well as your name and email address to [email protected].
Such a list will only be provided if required by applicable law. For the avoidance of doubt, if we are not obligated to provide you with the Winners list under applicable law, we shall in no way be obligated to respond to your request.
15.2 YOU FURTHER ACKNOWLEDGE AND AGREE THAT YOUR PERSONAL IDENTIFYING INFORMATION MAY BE DISCLOSED TO THIRD PARTIES INCLUDING, WITHOUT LIMITATION, PLACING YOUR NAME ON A WINNERS LIST AND SHARING SAID WINNERS LIST PER REGULATORY REQUIREMENTS.
16.1 If we determine that your posts or comments: (i) on any of the RealPrize social media pages are incorrect, damaging, libelous, illegal, defamatory, obscene, pornographic, sexual, offensive, abusive, indecent, threatening, bullying, spiteful, upsetting, harassing, hateful, offensive or otherwise unlawful or prejudicial of any person or group on the grounds of race, religion, sex, sexual orientation, age or disability; or (ii) elsewhere, which are unfair, incorrect, damaging, harassing, bullying, spiteful or upsetting, which is directed at us, our representatives or other end users of the Services, we reserve the right to:
16.1.1 remove the posts or comments;
16.1.2 disqualify you from participating in the Sweep Coins Mode Contests and using the Sweep Coins;
16.1.3 inform the operator or owner of the social media platform; or
16.1.4 terminate or suspend your account.
16.2 If we terminate your User Account under these Promotional Play Rules, Clauses 13.6-13.10 (inclusive) (TERMINATION OF YOUR USER ACCOUNT) in the General Terms and Conditions shall apply and in the event, we suspend your User Account under these Promotional Play Rules, Clause 13.5 (TERMINATION OF YOUR USER ACCOUNT) in the General Terms And Conditions shall apply.
